General Terms and Conditions “Job Provider”

– hereinafter: ” najdidelo.si ” or “we”
(1) All offers, sales contracts, deliveries and services based on orders placed by our customers (hereinafter referred to as entrepreneurs) are subject to these General Terms and Conditions.
(2) The General Terms and Conditions shall only apply if the entrepreneur is a legal entity under public law or a special fund under public law. For the purposes of these General Terms and Conditions, an “Entrepreneur” is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding the contract (§ 14 para. 1 BGB).
(3) Terms and conditions of the entrepreneur shall not apply, even if we do not separately object to their validity in individual cases.
(4) The contracts with the entrepreneur are concluded exclusively in Slovenian or English. If the order is placed by the Contractor in Slovenian the Slovenian version of these General Terms and Conditions shall apply accordingly. If the order is placed in English, only the English version of these General Terms and Conditions shall be authoritative.
(1) Our offers presented online are non-binding.
(2) Unless expressly stated otherwise in the offer, we shall be bound by our offers and cost estimates for 14 calendar days after dispatch. The entrepreneur is entitled to accept the offer within this period. The time at which we receive the contractor’s acceptance shall be decisive for compliance with the deadline.
(3) An advertisement contract is concluded when najdidelo.si confirms the advertisement application in writing (e-mail is sufficient) or when najdidelo.si publishes the job advertisement on the Internet. The written form is maintained by the sending of a fax or an e-mail.
(1) Our prices are exclusive of the statutory value added tax. All fees arising from the payment process shall be borne by the entrepreneur.
(2) The invoice is issued after the order has been placed and is sent to the entrepreneur by e-mail or by post. The Contractor expressly consents to the transmission of invoices by e-mail.
(3) In the absence of any other agreement, the invoice is due without deductions immediately after delivery.
(4) The entrepreneur is not entitled to any right of set-off or retention unless the counterclaim is undisputed or legally established.
(5) If the Contractor fails to pay on the due date, interest shall be charged on the outstanding amounts from the due date at a rate of nine percentage points above the respective base interest rate. The assertion of higher interest rates and further damages in the event of default shall remain unaffected.
(1) najdidelo.si publishes job advertisements of the entrepreneur on the Internet on the online platforms operated by najdidelo.si (jobadler.at incl. its regional and industry-specific job platforms).
(2) nadidelo.si reserves the right to reject advertisement applications without giving reasons and not to publish the advertisement. This applies in particular if the content or appearance of the job advertisement violates legal or official prohibitions or morality or if publication is unreasonable for najdidelo.si for other reasons.
(3) The advertisement will be published after conclusion of the advertising contract at the agreed time, but in any case only after receipt of the payment of the entrepreneur. If no publication date has been agreed, publication shall take place as soon as possible after conclusion of the advertising contract and payment by the Contractor.
(4) The Contractor shall be responsible for the complete delivery of faultless, suitable advertising media. nadidelo.si is not responsible for any delays in content or technical nature caused by the Contractor. If the entrepreneur enters an advertisement himself, it will be published immediately on the corresponding nadidelo.si online platforms. However, Najdidelo.si reserves the right to delete the advertisement at any time if the content or appearance of the advertisement violates legal or official prohibitions or morality or if publication is unreasonable for najdidelo.si for other reasons. najdidelo.si is not obliged to store the placed advertisement and its associated stored data after termination of the advertising contract.
(5) najdidelo.si is entitled on the basis of the advertisement contract to arrange for the publication of the company’s job advertisements on its Internet pages as well as within the framework of cooperations on the platforms of cooperation partners. A reference to job advertisements which are published on other job platforms is excluded. najdidelo.si is entitled to publish the job advertisements in any freely selectable print medium or to have them published by third parties.
(6) najdidelo.si commits itself to publish changes of the entrepreneur to his advertisements electronically within the contractually valid term, as far as this is technically and contentwise reasonable. Changes that affect the core content of an advertisement, in particular the title of the job advertisement and the job title, are excluded.
(7) The sending of contact messages to applicants is inadmissible as far as unfair, immoral or offensive contents are sent, an offence against morality or legal regulations is present or najdidelo.si a toleration of the procedure is unreasonable for other reasons. najdidelo.si is entitled to block access in this case.
(8) The content of the advertisement is the sole responsibility of the entrepreneur. In particular, it must be ensured that the job advertisement, including any image and video material, does not violate any statutory provisions such as copyright provisions or the General Equal Treatment Act.
(1) The entrepreneur undertakes to observe the provisions of the applicable data protection law, also with regard to the applicants supplied via najdidelo.si.
(2) In particular, the Contractor undertakes to treat all data and information of the Applicants confidentially and not to make it accessible to third parties. This obligation shall remain in force beyond the termination of the contract and the business relationship.
(3) The Contractor may use the contact data of an applicant solely for the purpose of filling a vacant position of the Contractor.
(4) The entrepreneur will indemnify najdidelo.si from all claims of third parties, which arise from and in connection with data protection violations of the entrepreneur.
(1) Advertisement contracts and the contract on the right to access the applicant pool shall automatically expire upon expiry of the time limit agreed in the individual case.
(2) najdidelo.si and entrepreneurs may terminate the business relationship or parts thereof with immediate effect at any time for good cause. Important reasons are in particular breaches of duty by the entrepreneur against the GTC and other contractual agreements.
(1) najdidelo.si guarantees the preparation and publication of the information/job advertisement requested by the client in accordance with the usual, current technical standard. The Contractor acknowledges that it is not possible according to the state of the art to create a completely error-free program. There are no errors in the presentation of the desired information if this is caused by the use of unsuitable software and hardware as well as failures in the communication network.
(2) Claims of the entrepreneur for damages are excluded. Excluded from this are claims for damages of the entrepreneur from injury to life, body, health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by najdidelo.si, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the goal of the contract.
(3) In case of violation of essential contractual obligations najdidelo.si is only liable for the contract-typical, foreseeable damage, if this was caused by simple negligence, unless it concerns claims for damages of the entrepreneur due to injury of life, body or health.
(4) The restrictions of paragraphs 1 and 2 also apply in favour of the legal representatives and vicarious agents of najdidelo.si if claims are asserted directly against them.
(5) najdidelo.si is not liable for the technical usability. Temporary technical failures may occur due to capacity limits, safety requirements and maintenance work.
(1) The sales contract existing between us and the entrepreneur shall be subject to the law of the Federal Republic of Austria to the exclusion of the UN Convention on Contracts for the International Sale of Goods, subject to mandatory international private law provisions.
(2) If the entrepreneur is a merchant within the meaning of the German Commercial Code (Kaufmann iSd. § (2) If the entrepreneur is a merchant as defined in Section 1 (1) of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, the courts responsible for Klagenfurt am Wörthersee, Austria, shall have exclusive jurisdiction for all disputes arising out of or in connection with the contractual relationship in question. In all other cases, we or the entrepreneur may bring an action before any court having jurisdiction on the basis of statutory provisions.
The customer can deactivate his advertisement (or additional option, service, etc.) at any time, even before the agreed time has expired. This does not mean withdrawal in the sense of the KSchG. In this case, the customer remains obliged to pay the full remuneration.
As soon as an advertisement (or additional option, service, etc.) has been paid for and published, the contract is deemed concluded. No refunds or credits will be offered for advertisements that have already been published. The advertisements can be edited in the business account at any time, as often as desired, until the end of the placement period. najdidelo.si offers for commercial and private customers support by e-mail and also on the phone. The respective connection fees, respectively costs for e.g. value-added numbers, are borne by the customer.
The times at which support is available and the scope of the services to be provided by najdidelo.si can be seen at https:// najdidelo.si /contact. najdidelo.si cannot guarantee the availability of support.
In case of repeated use of these support services by najdidelo.si najdidelo.si is entitled to invoice the services.
Orally given information is not binding. najdidelo.si is not liable in this case.
The performance of the ordered services by najdidelo.si is carried out in the manner chosen by najdidelo.si and within the normal working hours.
Customers receive the invoice as well as reminders in paper form. najdidelo.si reserves the right to change the invoice form to electronic invoice according to the legal regulations. Customers will receive all necessary information about the conversion and the requirements etc. in writing, at least 1 month in advance. For the issuing of invoices in paper form after conversion to electronic invoicing, which is still desired by the customer, najdidelo.si reserves the right to charge a fee (e.g. environmental contribution, processing fee) – if legally permissible.
If e-mail invoices are sent, customers will receive them at the e-mail address provided. The invoices can also be viewed and downloaded in the administration area. The customer has to check these immediately. najdidelo.si points out that for electronic invoices a direct debit authorization of the advertiser is necessary.
The date of receipt of the invoice shall be deemed to be the date on which it can be retrieved or acknowledged by the customer under normal circumstances (e.g. receipt of the e-mail).

(1) All services provided by us to our customers (hereinafter: “Applicants”) are subject to these General Terms and Conditions.
(2) Our offer is directed equally at consumers and entrepreneurs. For the purposes of these General Terms and Conditions, (i) a consumer is any natural person who concludes the contract for a purpose which cannot be attributed to either his commercial or his self-employed professional activity (§ 13 of the German Civil Code – BGB) and (ii) an “entrepreneur” is a natural or legal person or a partnership with legal capacity who acts in the exercise of his commercial or self-employed professional activity when concluding the contract (§ 14 para. 1 BGB).
(3) The applicant’s terms and conditions shall not apply, even if we do not separately object to their validity in individual cases.
(4) The contracts with the applicant shall be concluded exclusively in Slovenian or English. If the order is placed in Slovenian, only the Slovenian version of these General Terms and Conditions shall apply. If the order is placed in English, only the English version of these General Terms and Conditions shall prevail.
(1) The use of our platform is possible without registration. Registration is necessary for certain special functions of our platform. For example, registered users can communicate directly with companies.
(2) Applicants can register via the “Register” button in the main menu. When registering, first and last names as well as a valid e-mail address must be provided, a password must be chosen and these GTC and the data protection provisions must be accepted. For registration, we use the so-called double opt-in procedure, i.e. your registration is not completed until you have previously confirmed your registration by clicking on the link contained in a confirmation e-mail sent to you for this purpose.
(1) The applicant is obliged to keep the password secret. The password can be changed by the applicant at any time.
(2) After successful registration, the applicant can set up a profile, whereby the decision as to which data is entered in the profile and also released for disclosure to job providers lies solely with the applicant.
(3) The applicant is prohibited from entering incomplete, false or misleading information. Actions that violate the network or system security or intend to do so (e.g. infiltrating a virus or Trojan) are prohibited and will be prosecuted under civil and criminal law.
(4) Entrepreneurs are given access to the data entered by the applicant. This allows entrepreneurs to contact applicants via najdidelo.si
Both the applicant and najdidelo.si may terminate the business relationship or individual parts thereof at any time without notice and without giving reasons. In particular, the applicant may do this by deactivating his/her profile.
(1) Claims for damages by the applicant are excluded. Excluded from this are claims for damages of the applicant from injury to life, body, health or from the violation of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by najdidelo.si, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the goal of the contract.

(1) The purchase contract existing between us and the applicant is subject to the law of the Federal Republic of Austria under exclusion of the UN Convention on Contracts for the International Sale of Goods, subject to mandatory international private law regulations.
(2) If the applicant is a merchant within the meaning of the German Commercial Code (Kaufmann). § (2) If the applicant is a businessman as defined in Section 1 (1) of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, the courts responsible for Klagenfurt am Wörthersee, Austria, shall have exclusive jurisdiction for all disputes arising out of or in connection with the contractual relationship in question. In all other cases, we or the applicant may bring an action before any court having jurisdiction on the basis of statutory provisions.
